New A Games - Terms of Service Agreement

1. Terms of Service for Utilization of New A Games Websites and Services

Before engaging with any website ("Site") or mobile games/applications and services (collectively referred to as the "Services") provided by NEW A GAMES ("Company" or "New A Games" or "New A"), it is crucial that you thoroughly read and understand the following Terms of Service Agreement ("Agreement" or "Terms of Service").

2. Terms and Binding Effect

This Agreement constitutes a legally binding contract between you and New A Games. By accessing the Site or any Services provided by New A Games, you acknowledge your acceptance of these Terms of Service. New A Games reserves the right to amend these Terms of Service at its sole discretion without prior notice. Updated terms will be posted on the Site, and it is your responsibility to review them periodically. Your continued use of the Services after any modifications to the Terms of Service constitutes acceptance of those changes.

This Agreement supersedes all prior agreements, representations, warranties, and understandings between you and New A Games concerning the subject matter herein, governing your use of the Site, its content, and any products or services provided through the Site.

In the event of a breach of these Terms of Service, New A Games reserves the right to take appropriate action, including the termination of your account and access to the Services.

4. Age of Users

Users between the ages of 13 and 18 require parental or legal guardian consent to utilize New A Games' Services. Parents can provide and verify consent through the Site or an authorized third-party provider accessible through the Services. New A Games advises parents to monitor their child's online activities and use of the Services closely. Parents who wish to revoke previously provided consent for their child's access to the Services should take appropriate action to disconnect from our Services.

New A Games disclaims responsibility for any activities conducted by individuals under the age of 13, with or without parental permission. By providing consent for your child to use the Services, you agree to the terms governing their usage.

5. Description of Sites and Services

New A Games operates online mobile gaming services, websites, and mobile applications tailored to enhance user gaming experiences.

6. Your Obligations

You agree that you will not do any of the following:

Use our Services where the laws that apply to you would prohibit you from using our Services;
Use our Services if we tell you to stop using our Services;
Sell, rent or give away your user ID, profile or any other type of account that is associated with your activity on our Services (collectively, “Account”), including any game progress saved to or associated with your Account;

Create an Account using a false identity or false information, or on behalf of someone other than yourself;
Engage in any act that we deem to be in conflict with the spirit or intent of our Services, as we determine at our sole discretion;
Abuse or make improper use of our support services;
Use our Services to violate, or in violation of: (i) any applicable law, regulation, or government order; (ii) any applicable contract, policy or rule of ours; or (iii) any party’s intellectual property rights, privacy rights or other proprietary rights;
Harass or threaten other players;
Use any harmful, threatening, abusive, defamatory, libelous, pornographic, obscene, hateful, or racially or ethnically offensive language in our Services;
Conduct any unlawful chats, messaging, or similar communications while using our Services;
Cheat, hack, interfere with, tamper with, damage, disable, overburden, impact or conduct any attack on our Services or our servers or systems in any way, including by means of submitting a virus or other malware to our Services, or overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” our Services;
Probe, scan, or test the vulnerability of our Services or any associated system or network, or circumvent, breach or modify our security or authentication measures without proper authorization;
Attempt to modify, reverse-engineer, decompile or disassemble our Services, including by reducing to a human-perceivable form any of the source code used in providing our Services;
Host, provide matchmaking services for, or intercept, emulate, or redirect the communication protocols used as part of any of our Services;
Create or use cheats, exploits, “mods”, hacks, software, bots, or any unauthorized third-party software designed to modify or interfere with our Services or anyone’s experience using our Services;
Transmit or make available in our Services any advertising, promotional materials or any other forms of solicitation;
Transmit to us or using our Services any material that contains viruses, worms, traps or malicious computer code;
Disrupt the normal flow of the applications and dialogue in our Services, or otherwise act in a manner that negatively affects other people’s ability to use our Services;
Collect, process or store personal data about other people using our Services for your commercial purposes, for the purposes of harassing, stalking or abusing other people, or for purposes or in ways that would violate their privacy or human rights;
Use any payment card in relation to our Services without the cardholder’s authorization;
Remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying any of our Services;
Use any of our or our licensors’ trademarks, service marks or tradenames, or any variations or misspellings thereof, without our or their authorization;
Attempt to do any of the above; or
Encourage anyone else to do any of the above.

7. Payment Obligations

7.1 Virtual Items

You may purchase Virtual Items within the Services for your personal and non-commercial entertainment. These Virtual Items remain the property of New A Games and are subject to our management and control. New A Games reserves the right to revoke access to Virtual Items at any time without liability.

7.2 Fees, Refunds, and Return Policy

All sales made through the Services are final, and refunds or exchanges are not provided unless required by law. Upon termination of your account or the Services, unused Virtual Items are forfeited without compensation.

8. Prohibited Uses

New A Games prohibits certain activities on its Sites and Services, including:

Unauthorized access to the Services.
Use of the Services for illegal purposes.
Modifying, reverse-engineering, or interfering with the Services.
Unauthorized transfers or sales of Virtual Items.
Use of third-party software to modify or interfere with the Services.
Hosting or providing unauthorized access to New A Games' games or mobile applications.

Violation of these prohibitions may result in the termination of your account and legal action.

9. Use of Software

9.1 User Content

When using the Services, you agree to abide by applicable laws and respect the intellectual property rights of others. You are responsible for any Content you provide or transmit through the Services and must not infringe upon third-party rights.

9.2 Limited License To Use The Services

New A Games grants you a limited, non-exclusive license to access and use the Services for personal, non-commercial entertainment purposes. Any unauthorized use of the Services is strictly prohibited.

9.3 Suspension and Termination of Account and Services

New A Games reserves the right to limit, suspend, terminate, modify, or delete accounts or access to the Services if users violate these Terms of Service or engage in illegal or improper use of the Services.

10. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes or circumstances outside of our reasonable control, including any acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, pandemic, energy, labor or materials.
